Purchase Policies

The following policies ("Purchase Policies") will apply to all purchases you make on the Website. All purchased products are referred to as "Product(s)".

Please note that these Purchase Policies may be replaced by a written contract if you have enrolled in certain services. Please refer to your contract when applicable. If no contract was provided, these Purchase Policies will control.

BY PURCHASING PRODUCT(S) FROM THE WEBSITE, YOU AFFIRM THAT YOU: A) ARE OF LEGAL AGE TO MAKE THE PURCHASE; B) THAT YOU MEET ANY AND ALL ELIGIBILITY REQUIREMENTS OUTLINED IN THESE PURCHASE POLICIES; AND C) YOU AGREE TO BIOMEBABE'S PURCHASE POLICIES AND TERMS OF USE.

Order Acceptance and Cancellation

By placing an order to purchase Products on the Website, your order is considered an offer to buy, under the terms set forth in these Purchase Policies, the products and/or services listed in your order. BIOMEbabe may review your order and determine whether or not to accept it; however, BIOMEbabe is not obligated to accept any order. BIOMEbabe reserves the right to limit the sale of Products to any person, geographic region, or jurisdiction on a case-by-case basis. If your order is rejected, you will be refunded for any payments made at the time you submitted your order.

Purchaser Eligibility

The Products are available to individuals over the age of 18 who are seeking support for themselves. The Products are not available for the following uses:

Those seeking to use the Products as the basis for a paid product or service, or any other use contrary to these Purchase Policies and the license granted herein.
Individuals seeking to incorporate BIOMEbabe methodologies, in whole or in part, into their own products or services.

If BIOMEbabe becomes aware that you have submitted an order in violation of these eligibility requirements, BIOMEbabe will immediately reject your order and reserves all rights to defend its intellectual property.

Prices

All prices listed on the Website are subject to change without notice. The price charged will be the price in effect at the time you submit your order. Any applicable sales tax or other charges will be added to your total before purchase is completed. BIOMEbabe reserves the right to correct errors in Product information, including pricing, and to cancel orders for Products that contained errors.

Payments

Unless otherwise stated, payments are due and will be collected at the time you place your order. All Products are hosted and sold through Whop, a third-party platform that processes payments via Stripe and PayPal. By purchasing any Product(s), you agree to pay the total amount due and authorize BIOMEbabe, through Whop's payment processing system, to charge your chosen payment method. By entering payment information, you represent: a) that all payment information is true and accurate; b) that you are authorized to use the payment method; and c) that all charges incurred will be honored by your payment method. Please note that your payment information is handled directly by Whop, Stripe, and/or PayPal and is subject to their respective terms of service and privacy policies.

Payment Plans & Automatic Payments

BIOMEbabe may offer payment plans or automatic payment options through Whop, in which you will place a payment method on file and authorize Whop's payment processing system (powered by Stripe and/or PayPal) to collect multiple payments. If you enroll in a Payment Plan, you agree to be responsible for all payments per the agreed schedule. You are solely responsible for ensuring your payment method remains current and error-free. If a payment cannot be collected when due, you will be notified and are responsible for immediately updating your payment method.

Missed Payments

If you fail to make a payment, BIOMEbabe may take the following actions:

Provide notice of the missed payment and offer a set period of time during which the payment must be made;
Revoke your access to any Product for which you have failed to make a payment, until such payment is received; or
Charge a late fee or interest, if you continue to receive access to the Products without remitting the payment due.

Refunds

30-Day Progress Guarantee. If you attend at least 4 weeks of live office hours, follow the Phase 1 sequence as outlined in the Program, and still don't experience meaningful progress, BIOMEbabe will refund your purchase.

Refund requests must be submitted within 30 days of your Phase 1 start date to biomebabe@gmail.com with a summary of your participation. BIOMEbabe will verify attendance and engagement records before approving or denying the request.

This guarantee does not apply to purchasers who do not meet the above participation criteria — for those purchasers, and for any refund request submitted outside the 30-day window, all sales are final. BIOMEbabe does not offer refunds, credits, or exchanges outside the terms of this guarantee, for any reason, including but not limited to general dissatisfaction with the Product or failure to achieve any particular result.

You agree that you have received and carefully reviewed this refund policy prior to making any purchase on the Website. If you live in a jurisdiction that has rules regarding refunds that conflict with these Purchase Policies, BIOMEbabe will honor the rules of that jurisdiction where applicable. You agree that you will not file any disputes or request chargebacks through your credit card issuer; if you do, this refund policy will be provided in BIOMEbabe's defense.

Discounts

Occasionally, BIOMEbabe may offer discounts on its Products at its sole discretion. Discounts may be available for a limited time and will not be honored after expiration. BIOMEbabe does not offer refunds for failure to apply a discount at the time of purchase and does not offer price adjustments for discounts offered after the time of purchase.

Bonuses

Occasionally, BIOMEbabe will offer bonuses with a purchase. These bonuses will only be available in accordance with the terms of the specific offer made at the time of purchase and will not be available for later request or redemption to past or future purchasers.

Account Creation & Access to Products

To access the Product(s), you may be required to create an account on BIOMEbabe's platform. You are responsible for keeping your login information private. If BIOMEbabe suspects that your login credentials have been shared with a third party or compromised, BIOMEbabe reserves the right to revoke your access. The duration of your access to the Products will be communicated at the time of purchase and may vary by Product.

Group Calls

As part of certain Products, BIOMEbabe may periodically host calls or video conferences to which you will be invited. If you attend these calls, you agree to follow any Community guidelines. BIOMEbabe reserves the right to record and make these recordings available in its sole discretion. By participating, you grant BIOMEbabe the right to record the call, which may include your likeness, name, and any content you contribute. You understand that you will not be permitted to request removal of this content after the group call is completed.

Conduct

BIOMEbabe reserves the right to remove any participant from a Product if their behavior is disruptive, disrespectful, or unsafe to others. This is to maintain the integrity of the community space. In such cases, no refunds will be issued.

License to Use the Products

BIOMEbabe is the creator and owner of the Products, subject to any licensed materials that authorize BIOMEbabe to utilize certain content within the Products. BIOMEbabe reserves all rights in the Products. By purchasing the Products, BIOMEbabe grants you, the purchaser, a revocable limited license for your personal use only. Commercial use of the Products is strictly prohibited. You may not share, distribute, display, perform, resell, republish, or create derivative works based upon the Products. You may not reproduce or resell the information to third parties.

Artificial Intelligence

Unless BIOMEbabe has expressly provided its authorization, you are strictly prohibited from entering information from the Products into any type of generative artificial intelligence tool if it will be used in the training, development, or operating of any machine learning systems. If you are unsure what an AI tool does in this regard, please review its terms before use. When in doubt, refrain from entering BIOMEbabe Content into the tool.

BIOMEbabe does not consent to the use of any portion of this Website or the BIOMEbabe Content, in whole or in part, for the development, training, or operating of artificial intelligence or other machine learning systems, unless authorized through a separate written agreement. Any unauthorized use will be considered a breach of these Terms and may constitute a breach of rights under United States copyright law.

Commercial Usage of the Products

Commercial usage of the Products is strictly prohibited unless you have received a written license from BIOMEbabe and have paid the respective fees for such license. To inquire about obtaining a commercial license, you may contact BIOMEbabe at biomebabe@gmail.com. A separate written agreement will be required. Pricing varies based on your intended usage and will be discussed after you submit your inquiry.

Downloadable Files

If you purchase any Products that involve downloadable files, you understand that you are downloading files at your own risk. BIOMEbabe is not liable for any errors or omissions in these downloadable files, nor for any technological problems you may encounter downloading them.

Product Language

Unless otherwise stated, all Products are offered in English. BIOMEbabe is not responsible for offering translations of the Products and cannot guarantee that translation tools will accurately translate the content of the Products.

Communication About Products

If you purchase a Product, you will enter your email address at the time of purchase. You agree that BIOMEbabe may email you regarding your purchase. You may also be added to our mailing list to receive additional information about our products and services, if you opt in at the time of your purchase.

From time to time, the BIOMEbabe Content will legally reference trademarks owned by third parties. These trademarks are the respective property of their owners and BIOMEbabe makes no claim of ownership.

Content Contributed to the Website

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnity

You agree to defend, indemnify, and hold BIOMEbabe, its members, employees, officers, directors, managers, and agents harmless from and against any and all losses, claims, suits, actions, liabilities, obligations, costs, and expenses (including reasonable attorneys' fees and expenses) which BIOMEbabe suffers as a result of third-party claims based on: (i) your negligence or intentional misconduct; (ii) your breach of any provision of the Terms; (iii) materials prepared or provided by you, including any claims of infringement or misappropriation of copyright, trademark, patent, trade secret, or other intellectual property or proprietary right, infringement of rights of privacy or publicity, or defamation or libel; or (iv) death, personal injury, or property damage arising out of, or relating to, your obligations hereunder.

Arbitration

These Terms will be governed and construed in accordance with the laws of the State of Nevada. Any controversy or claim arising out of or relating to the Terms, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of any such arbitration shall be in or near Clark County, Nevada. The parties also agree that the AAA Optional Rules for Emergency Measures of Protection shall apply to the proceedings.

Miscellaneous Provisions

If any provision(s) of the Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall be severable and enforceable. If a provision is excessively broad, such a provision shall be limited or reduced in scope so as to be enforceable. The Terms may not be assigned by you without BIOMEbabe's prior written consent; however, the Terms may be assigned by BIOMEbabe in its sole discretion. The Terms are the final, complete, and exclusive agreement of the parties with respect to the Website offered by BIOMEbabe; however, BIOMEbabe may make modifications as stated above. All notices with respect to the Terms must be in writing and may be sent via email to biomebabe@gmail.com for BIOMEbabe and to your email address on file.
